Local Bankruptcy Rules — Western District of Missouri

What the Local Bankruptcy Rules do

Each U.S. bankruptcy court adopts Local Bankruptcy Rules under the authority of Federal Rule of Bankruptcy Procedure 9029 and 28 U.S.C. § 2071. The Local Rules supplement (they do not displace) the Federal Rules of Bankruptcy Procedure (Fed. R. Bankr. P.) and the Bankruptcy Code (11 U.S.C.). They govern day-to-day procedure: formatting, hearing scheduling, motion practice, electronic filing, and chambers procedures.

The Western District of Missouri LBRs are codified as W.D. Mo. LBR 1001 through 9037, mirroring the chapter and rule structure of the Federal Rules.

Local-rule highlights for pro se filers

The provisions below are common touchpoints. They are summarized for orientation only; the official rule controls.

W.D. Mo. LBR 1002 — Petition

Implements Fed. R. Bankr. P. 1002 on petition filing. Pro se debtors typically file paper petitions at the Charles Evans Whittaker Courthouse clerk's office in Kansas City or at the Springfield divisional office.

W.D. Mo. LBR 2002 — Notices

Supplements Fed. R. Bankr. P. 2002 governing notices to creditors. Specifies the Bankruptcy Noticing Center (BNC) as the default noticing channel.

W.D. Mo. LBR 3015 — Chapter 13 Plans

Governs Chapter 13 plan format. The Western District of Missouri uses the national Official Form 113 Chapter 13 plan, with district-specific local administrative procedures for the standing trustee. Confirmation procedure is addressed in this rule.

W.D. Mo. LBR 4001 — Stay Relief and Cash Collateral

Implements Fed. R. Bankr. P. 4001 on motions for relief from the automatic stay (11 U.S.C. § 362) and use of cash collateral (11 U.S.C. § 363).

W.D. Mo. LBR 5005 — Filing Papers (CM/ECF)

Authorizes electronic filing through CM/ECF and addresses signatures, file format (PDF), and service. The court provides electronic-filing tools for self-represented litigants for limited post-petition filings.

W.D. Mo. LBR 9011 — Signatures and Sanctions

Tracks Fed. R. Bankr. P. 9011, mirroring Fed. R. Civ. P. 11. Every paper submitted to the court is a representation that the filing is well grounded in fact and warranted under existing law.

W.D. Mo. LBR 9037 — Privacy Redactions

Implements Fed. R. Bankr. P. 9037: redact full Social Security numbers (last four only), full taxpayer-identification numbers, full birth dates (year only), financial-account numbers (last four only), and minor children's names (initials only).

General Orders

The court issues General Orders that supplement specific procedures — for example, mortgage modification mediation, chapter-specific scheduling templates, or temporary measures. The current set is published on the court's general orders page.
